Terms of Service

1. Agreement to these terms
These Terms of Service (“Terms”) govern access to and use of the websites, platform, and related services provided by Public Housing Center, LLC, a North Carolina limited liability company (“PHC,” “we,” “us,” or “our”), including publichousingcenter.com and app.publichousingcenter.com (collectively, the “Services”). By accessing or using the Services, you agree to these Terms. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization, and “you” refers to that organization.
If your organization has a separate written agreement with PHC (such as a master services agreement, subscription agreement, or order form), that agreement controls to the extent it conflicts with these Terms.
2. The services
PHC provides a workflow and communications platform for public housing authorities, including an AI-assisted call center, text and email messaging, and case workflow tools for programs such as recertifications, lease-ups, and waitlist management. Features vary by subscription, and we may improve or modify the Services over time.
3. Accounts and eligibility
Platform accounts are provisioned for authorized staff of our customers. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us promptly at biz@publichousingcenter.com if you suspect unauthorized use. You must be at least 18 years old to hold an account.
4. Customer data
As between you and PHC, your organization owns the data it submits to or generates through the Services, including resident, applicant, and landlord records (“Customer Data”). You grant PHC the right to host and process Customer Data as needed to provide the Services, consistent with our Privacy Policy and any written agreement between us. You are responsible for having the necessary rights and notices in place to provide Customer Data to us, and for the accuracy of the data you submit.
5. Acceptable use
You agree not to:
- Use the Services in violation of applicable law, including housing, fair housing, privacy, and telemarketing laws;
- Access another organization’s data or attempt to bypass access controls, rate limits, or security measures;
- Use the Services to send unsolicited marketing messages or any messages to recipients who have opted out;
- Reverse engineer, resell, or provide the Services to third parties except as agreed in writing;
- Interfere with or disrupt the integrity or performance of the Services.
We may suspend or limit access to protect the Services, other customers, or the people whose data the Services process.
6. AI-assisted features
Parts of the Services use artificial intelligence — for example, an automated voice assistant that answers calls, generates transcripts and summaries, and drafts follow-up messages. AI output can contain errors or omissions. The Services are designed so that your staff review and remain responsible for decisions; AI output is provided to assist your staff, is not legal advice, and should not be the sole basis for any determination affecting a person’s housing, benefits, or eligibility.
7. Text messaging
The Services can send service-related text messages such as appointment confirmations, document links, and case status updates. Message frequency varies based on account and case activity. Message and data rates may apply. Recipients can reply STOP at any time to opt out, START to resume, or HELP for assistance. Customers are responsible for obtaining any consents required from their program participants for messages the customer directs us to send. Mobile numbers and text messaging opt-in data are never shared with third parties or affiliates for marketing or promotional purposes.
8. Third-party services
The Services rely on third-party providers such as telephony and messaging carriers, cloud hosting, and AI voice technology. We are not responsible for failures of telecommunications networks or other services outside our reasonable control, though we choose and manage our providers with care.
9. Intellectual property
PHC and its licensors own the Services, including all software, design, and content we provide (excluding Customer Data). We grant you a limited, non-exclusive, non-transferable right to use the Services during your subscription in accordance with these Terms. If you send us feedback or suggestions, we may use them without restriction or obligation to you.
10. Fees
Fees for the platform are set out in the applicable order form or agreement between PHC and your organization. Except as stated there or required by law, fees are non-refundable.
11. Term and termination
These Terms apply while you use the Services. Subscription terms and termination rights for paying customers are set out in the applicable agreement. We may suspend or terminate access for material breach of these Terms. Upon termination, your right to use the Services ends; provisions that by their nature should survive (including Sections 4 and 9 through 14) survive termination.
12. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, PHC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED OUTPUT WILL BE ACCURATE OR COMPLETE.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PHC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, PHC’S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS WILL NOT EXCEED THE AMOUNTS PAID BY YOUR ORGANIZATION TO PHC FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS ($100) IF NO SUCH AMOUNTS WERE PAID. THESE LIMITS DO NOT APPLY WHERE PROHIBITED BY LAW.
14. Indemnification
You will defend and indemnify PHC against third-party claims arising from your misuse of the Services, your violation of these Terms, or your violation of applicable law, except to the extent caused by PHC’s breach of these Terms.
15. Governing law
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of laws rules. The parties will first attempt in good faith to resolve any dispute informally by contacting biz@publichousingcenter.com.
16. Changes to these terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page, and for material changes we will provide additional notice. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
